Has Obama’s Kenya Birth Certificate Been Found?

WASHINGTON – California attorney Orly Taitz, who has filed a number of lawsuits demanding proof of Barack Obama’s eligibility to serve as president, has released a copy of what purports to be a Kenyan certification of birth and has filed a new motion in U.S. District Court for its authentication.

The document lists Obama’s parents as Barack Hussein Obama and Stanley Ann Obama, formerly Stanley Ann Dunham, the birth date as Aug. 4, 1961, and the hospital of birth as Coast General Hospital in Mombasa, Kenya.

No doctor is listed. But the alleged certificate bears the signature of the deputy registrar of Coast Province, Joshua Simon Oduya. It was allegedly issued as a certified copy of the original in February 1964.

WND was able to obtain other birth certificates from Kenya for purposes of comparison, and the form of the documents appear to be identical.

Last week, a counterfeit document purporting to be Obama’s Kenyan birth certificate made the rounds of the Internet, but was quickly determined to be fraudulent. The new document released by Taitz bears none of the obvious traits of a hoax.

One of the issues Taitz must deal with will be the authentication of the document. Critics immediately jumped on the Feb. 17, 1964, date for the document, explaining that the "republic" of Kenya wasn’t assembled until in December of that year.

Media Matters wrote, "Sorry, WorldNetDaily: Kenya wasn’t a republic until Dec. 1964."

But Kenya’s official independence was in 1963, and any number of labels could have been applied to government documents during that time period.

At Ameriborn Constitution News, the researcher noted that the independence process for the nation actually started taking as early as 1957, when there were the first direct elections for Africans to the Legislative Council.

"Kenya became an Independent Republic, December 12, 1963, which gives more [credibility] that this is a true document," the website stated.

The 1963 independence is corroborated by several other information sources, including the online African History.

Even the People Daily news agency cited, on Dec. 12, 2005, the "42nd independence anniversary" in Nairobi. "The country gained independence from Britain on Dec. 12, 1963," the report said.

An online copy of the Kenya Constitution, "adopted in 1963, amended in 1999," states: "CHAPTER I - THE REPUBLIC OF KENYA, Article 1, Kenya is a sovereign Republic. Article 1A, The Republic of Kenya shall be a multiparty democratic state…"

It was in November 1964 when the region voluntarily became a one-party state, according to an online source.

The region including Mombasa originally was dealt with as a separate independence movement, but it almost immediately became part of Kenya when the sultan of Zanzibar ceded the "coastal strip" to Kenya, according to sources.

Taitz told WND that the document came from an anonymous source who doesn’t want his name known because "he’s afraid for his life."

Taitz’s motion, filed yesterday in the U.S. District Court for the Central District of California, requests the purported evidence of Obama’s birth – both the alleged birth certificate and foreign records not yet obtained – be preserved from destruction, asks for permission to legally request documents from Kenya and seeks a subpoena for deposition from Secretary of State Hillary Clinton.

"I filed the motion with the court asking for expedited discovery, which would allow me to start subpoenas and depositions even before Obama and the government responds," Taitz told WND. "I am asking the judge to give me the power to subpoena the documents from the Kenyan embassy and to require a deposition from Hillary Clinton so they will be forced to authenticate [the birth certificate].

"I’m forcing the issue, where Obama will have to respond," she said.

"Before, they said, ‘You don’t have anything backing your claims,’" Taitz explained. "Now I have something. In fact, I have posted on the Internet more than Obama has. My birth certificate actually has signatures."

Taitz’s most celebrated case involved a military officer, Maj. Stefan Cook, whose order to deploy to Afghanistan was revoked when he challenged Obama’s eligibility to hold office. That case has now been refiled in federal court in Florida, raising the specter of a class-action claim among members of the military that their orders aren’t valid because of questions surrounding Obama’s constitutional eligibility.

Taitz told WND she plans to file additional paperwork with the Florida court tomorrow, adding the alleged Kenyan birth certificate to Maj. Cook’s case.

The suit seeks damages and a declaratory judgment. Named as defendants are Simtech, Cook’s former civilian employer, and several officials, including Col. Louis B. Wingate and Secretary of Defense Robert Gates.

WND previously reported a judge in Georgia dismissed Cook’s case when the government suddenly revoked his orders to report to Fort Benning for deployment to Afghanistan.

WND reported when the case originally was filed that Cook’s concern was that without proof that there is a legitimate commander in chief, the entire U.S. Army becomes "merely a corps of chattel slaves under the illegitimate control of a private citizen."

Cook told WND: "As an officer in the armed forces of the United States, it is [my] duty to gain clarification on any order we may believe illegal. With that said, if President Obama is found not to be a ‘natural-born citizen,’ he is not eligible to be commander in chief."

The new complaint says it seeks Cook’s reinstatement with his civilian employer, Simtech Inc., as well as protection from the Department of Defense and president "from further retaliation for plaintiff’s challenge to the president’s constitutional authority."

WND has reported on dozens of legal challenges to Obama’s status as a "natural born citizen." The Constitution, Article 2, Section 1, states, "No Person except a natural born Citizen, or a Citizen of the United States, at the time of the Adoption of this Constitution, shall be eligible to the Office of President."

Some of the lawsuits question whether he was actually born in Hawaii, as he insists. If he was born out of the country, Obama’s American mother, the suits contend, was too young at the time of his birth to confer American citizenship to her son under the law at the time.

Other challenges have focused on Obama’s citizenship through his father, a Kenyan subject to the jurisdiction of the United Kingdom at the time of his birth, thus making him a dual citizen. The cases contend the framers of the Constitution excluded dual citizens from qualifying as natural born.

Complicating the situation is Obama’s decision to spend sums estimated in the hundreds of thousands of dollars to avoid releasing a state birth certificate that would put to rest all of the questions.

WND has reported that among the documentation not yet available for Obama includes his kindergarten records, his Punahou school records, his Occidental College records, his Columbia University records, his Columbia thesis, his Harvard Law School records, his Harvard Law Review articles, his scholarly articles from the University of Chicago, his passport, his medical records, his files from his years as an Illinois state senator, his Illinois State Bar Association records, any baptism records, and his adoption records.

A U.S. Army Reserve major from Florida scheduled to report for deployment to Afghanistan within days has had his military orders revoked after arguing he should not be required to serve under a president who has not proven his eligibility for office.

His attorney, Orly Taitz, confirmed to WND the military has rescinded his impending deployment orders.

"We won! We won before we even arrived," she said with excitement. "It means that the military has nothing to show for Obama. It means that the military has directly responded by saying Obama is illegitimate – and they cannot fight it. Therefore, they are revoking the order!"

She continued, "They just said, ‘Order revoked.’ No explanation. No reasons – just revoked."

A hearing on the questions raised by Maj. Stefan Frederick Cook, an engineer who told WND he wants to serve his country in Afghanistan, was scheduled for July 16 at 9:30 a.m.

"As an officer in the armed forces of the United States, it is [my] duty to gain clarification on any order we may believe illegal. With that said, if President Obama is found not to be a ‘natural-born citizen,’ he is not eligible to be commander-in-chief," he told WND only hours after the case was filed.

"[Then] any order coming out of the presidency or his chain of command is illegal. Should I deploy, I would essentially be following an illegal [order]. If I happened to be captured by the enemy in a foreign land, I would not be privy to the Geneva Convention protections," he said.

The order for the hearing in the federal court for the Middle District of Georgia from U.S. District Judge Clay D. Land said the hearing on the request for a temporary restraining order would be held Thursday.

Cook said without a legitimate president as commander-in-chief, members of the U.S. military in overseas actions could be determined to be "war criminals and subject to prosecution."

He said the vast array of information about Obama that is not available to the public confirms to him "something is amiss."

"That and the fact the individual who is occupying the White House has not been entirely truthful with anybody," he said. "Every time anyone has made an inquiry, it has been either cast aside, it has been maligned, it has been laughed at or just dismissed summarily without further investigation.

"You know what. It would be so simple to solve. Just produce the long-form document, certificate of live birth," he said.

Cook said he was scheduled to report for duty tomorrow, on July 15, to deploy to Afghanistan as part of President Obama’s plan to increase pressure of insurgent forces there.

He told WND he would be prepared for a backlash against him as a military officer, since members of the military swear to uphold and follow their orders. However, he noted that following an illegal order would be just as bad as failing to follow a legal order.

Before news of the orders being revoked were reported, MSNBC anchor Keith Olbermann tonight called Cook a "jackass" and Taitz a "conwoman," as he labeled both of them the "worst persons in the world." He flayed the soldier as "an embarrassment to all those who have served without cowardice."

Named as defendants in the case are Col. Wanda Good, Col. Thomas Macdonald, Secretary of Defense Robert Gates and Obama, described as "de facto president of the United States."

According to the court filing, Cook affirmed when he joined the military, he took the following oath: "I, Stefan Frederick Cook, do solemnly swear (or affirm) that I will support and defend the Constitution of the United States against all enemies, foreign and domestic; that I will bear true faith and allegiance to the same; and that I will obey the orders of the president of the United States and the orders of the officers appointed over me, according to the regulations and the Uniform Code of Military Justice. So help me God."

According to the claim, "Plaintiff submits that it is implicit though not expressly stated that an officer is and should be subject to court-martial, because he will be derelict in the performance of his duties, if he does not inquire as to the lawfulness, the legality, the legitimacy of the orders which he has received, whether those orders are specific or general."

The military courts offer no option for raising the question, so he turned to civilian courts to consider "a question of paramount constitutional and legal importance: the validity of the chain of command under a president whose election, eligibility, and constitutional status appear open to serious question."

"Barack Hussein Obama, in order to prove his constitutional eligibility to serve as president, basically needs only produce a single unique historical document for the Plaintiff’s inspection and authentication: namely, the ‘long-form’ birth certificate which will confirm whether Barack Hussein Obama was in fact born to parents who were both citizens of the United States in Honolulu, Hawaii, in or about 1961," explains the complaint.

Taitz said she will attend the hearing to amend the temporary restraining order to an injunction because more members of the military have joined the cause.

"We are going to be asking for release of Obama’s records because now this completely undermines the military. It revoked this order, but it can come up with another order tomorrow. It can come up with orders for other people," she said. "Am I going to be flying around the country 1,000 times and paying the fees every time they issue an order?"

Taitz said the issue "must be resolved immediately," and she will continue working to ensure Obama proves he is eligible for office.

"We’re going to be asking the judge to issue an order for Obama to provide his vital records to show he is legitimately president," she said. "We’re going to say, we have orders every day, and we’ll have revocations every day. This issue has to be decided."

She said there cannot be any harm to the president if he is legitimately holding office.

"If he is legitimate, then his vital records will prove it," Taitz said. "If he is illegitimate, then he should not have been there in the first place."

Asked what this decision means for every other serviceman who objects to deployment under a president who has not proven he is eligible for office, Taitz responded:

"Now, we can have each and every member of the military – each and every enlistee and officer – file something similar saying ‘I will not take orders until Obama is legitimately vetted.’"

Multiple questions have been raised about what that would mean to the 2008 election, to the orders and laws Obama has signed and other issues, including whether he then is a valid commander-in-chief of the military.

A lawyer investigating the eligibility of Barack Obama to be president under the U.S. Constitution’s requirement that the office be occupied only by a "natural born" citizen is asking the U.S. Supreme Court to cooperate with an FBI investigation into alleged cyber crimes connected to her work.

In a letter addressed yesterday to Chief Justice John Roberts, the associate justices, the Secret Service and others, California lawyer Orly Taitz, who is working on a number of eligibility cases through the Defend Our Freedoms Foundation, wrote, "I hope that the Supreme Court will show proper cooperation in investigation of such crimes by the FBI and other agencies and I request a letter of cooperation to that extent."

Taitz is just one of many attorneys across the country whose clients are raising questions about Obama’s eligibility.

Taitz is one of several lawyers who have brought emergency motions to the U.S. Supreme Court over the cases, only to have them dropped without a hearing.

While her effort was pending at the court, its references suddenly were scrubbed from the public website just two days before a conference among justices on the case was to be heard.

She filed a complaint with the FBI, which promised a review, but the investigative agency noted that in that situation, technically the Supreme Court was the "victim" of having its website hacked, and officials there would need to cooperate for the effort to move forward.

That circumstance generated Taitz’ letter requesting cooperation.

"This is particularly important in light of the fact that there is a common denominator in a number of cyber crimes committed," Taitz wrote. She cited a hacking into her PayPal account where donations to her foundation allegedly could have been diverted, sabotage on her website and the creation of an "imposter site" for one of the plaintiffs in one of her cases.

"All of these cyber crimes, together with all the other crimes that are handled separately, have one common denominator – a concerted effort to put Obama in the White House and keep him there by virtue of fraud and concealment of all of his records," she wrote.

The president also has been named in an indictment turned in by a peoples’ grand jury in Georgia, and one other man has sought a criminal complaint against the president.

Taitz also told WND she has forwarded to U.S. Attorney Jeffrey Taylor in Washington, D.C., a request for the U.S. to relate Quo Warranto "on Barack Hussein Obama, II to test his title to president."

Named as plaintiffs in the action are nine military or legislative leaders, including Allen C. James, currently on active duty in the U.S. Army in Iraq. Others include several retired military leaders as well as elected state representatives.

"Relators request that as U.S. Attorney, you institute a Quo Warranto proceeding against Obama under DC Code § 16-3502, and demand that Obama show clear title, proving, with clear and convincing evidence, that he had qualified as president elect," Taitz told Taylor.

"By each relator’s constitutional oath of office, and interest above other citizens and taxpayers, relators submit that they have standing," Taitz wrote.

"In arguendo of Respondent Obama’s burden of proof, motions are submitted requesting mandamus on Hawaii Gov. Linda Lingle for evidence, and on Sec. State Hillary Rodham Clinton for evidence and to request evidence from Britain and the Republics of Kenya, Indonesia and Pakistan," Taitz said.

"Quo Warranto" essentially means an explanation is being demanded for what authority Obama is using to act as president. An online constitutional resource says Quo Warranto "affords the only judicial remedy for violations of the Constitution by public officials and agents."

John Eidsmoe, an expert on the U.S. Constitution now working with the Foundation on Moral Law, said the demand is a legitimate course of action.

"She basically is asking, ‘By what authority’ is Obama president," he told WND. "In other words, ‘I want you to tell me by what authority. I don’t really think you should hold the office.’

Eidsmoe said it’s clear that Obama has something in the documentation of his history, including his birth certificate, college records and other documents, "he does not want the public to know."

What else could be the reason for his hiring law firms across the nation to fight any request for information as basic as his Occidental College records from the early 1980s, he asked.

As Jerome Corsi, WND senior staff writer, explained, "The main reason doubts persist regarding Obama’s birth certificate is this question: If an original Hawaii-doctor-generated and Hawaii-hospital-released Obama birth certificate exists, why wouldn’t the senator and his campaign simply order the document released and end the controversy?

"That Obama has not ordered Hawaii officials to release the document," Corsi writes, "leaves doubts as to whether an authentic Hawaii birth certificate exists for Obama."

Obama officials repeatedly have declined comment, relenting only one time to call such allegations "garbage."

WND reported earlier on a proposal by U.S. Rep. Bill Posey, R-Fla., and the criticism he’s taking for suggesting that the issue be avoided in the future by having presidential candidates supply their birth certificate.

Here is a partial listing and status update for some of the cases over Obama’s eligibility:

* New Jersey attorney Mario Apuzzo has filed a case on behalf of Charles Kerchner and others alleging Congress didn’t properly ascertain that Obama is qualified to hold the office of president.

* Pennsylvania Democrat Philip Berg has three cases pending, including Berg vs. Obama in the 3rd U.S. Circuit Court of Appeals, a separate Berg vs. Obama which is under seal at the U.S. District Court level and Hollister vs. Soetoro a/k/a Obama, (now dismissed) brought on behalf of a retired military member who could be facing recall to active duty by Obama.

* Leo Donofrio of New Jersey filed a lawsuit claiming Obama’s dual citizenship disqualified him from serving as president. His case was considered in conference by the U.S. Supreme Court but denied a full hearing.

* Cort Wrotnowski filed suit against Connecticut’s secretary of state, making a similar argument to Donofrio. His case was considered in conference by the U.S. Supreme Court, but was denied a full hearing.

* Former presidential candidate Alan Keyes headlines a list of people filing a suit in California, in a case handled by the United States Justice Foundation, that asks the secretary of state to refuse to allow the state’s 55 Electoral College votes to be cast in the 2008 presidential election until Obama verifies his eligibility to hold the office. The case is pending, and lawyers are seeking the public’s support.

* Chicago lawyer Andy Martin sought legal action requiring Hawaii Gov. Linda Lingle to release Obama’s vital statistics record. The case was dismissed by Hawaii Circuit Court Judge Bert Ayabe.

* Lt. Col. Donald Sullivan sought a temporary restraining order to stop the Electoral College vote in North Carolina until Barack Obama’s eligibility could be confirmed, alleging doubt about Obama’s citizenship. His case was denied.

* In Ohio, David M. Neal sued to force the secretary of state to request documents from the Federal Elections Commission, the Democratic National Committee, the Ohio Democratic Party and Obama to show the presidential candidate was born in Hawaii. The case was denied.

* Also in Ohio, there was the Greenberg v. Brunner case which ended when the judge threatened to assess all case costs against the plaintiff.

* In Washington state, Steven Marquis sued the secretary of state seeking a determination on Obama’s citizenship. The case was denied.

* In Georgia, Rev. Tom Terry asked the state Supreme Court to authenticate Obama’s birth certificate. His request for an injunction against Georgia’s secretary of state was denied by Georgia Superior Court Judge Jerry W. Baxter.

* California attorney Orly Taitz has brought a case, Lightfoot vs. Bowen, on behalf of Gail Lightfoot, the vice presidential candidate on the ballot with Ron Paul, four electors and two registered voters.

In addition, other cases cited on the RightSideofLife blog as raising questions about Obama’s eligibility include:

* In Texas, Darrel Hunter vs. Obama later was dismissed.

* In Ohio, Gordon Stamper vs. U.S. later was dismissed.

* In Texas, Brockhausen vs. Andrade.

A lawsuit filed on behalf of Ambassador Alan Keyes, a candidate for president on California’s general election ballot last year, challenging President Obama’s eligibility to hold office under the requirements of the U.S. Constitution will be appealed, according to a lawyer working on the case.

WND reported earlier on the case being filed and then again when a judge dismissed it after concluding anyone can run for president on the California ballot – whether or not they are eligible under the Constitution of the United States.

Judge Michael P. Kenny said the secretary of state, who is responsible for election laws in the state, has no "duty" to demand proof of eligibility from candidates.

But now Gary Kreep of the United States Justice Foundation has confirmed to WND the case will be appealed.

"The judge’s ruling in the case that only Congress and only on Jan. 6 of each year following a presidential election can object as to whether the nominee is eligible to serve as president of the United States is, in our opinion, completely wrong and eviscerates the [Constitutional] requirements for serving as president in the United States Constitution," Kreep said.

"It has been publicly reported that Mr. Obama as far back as 2006 had a relationship to a law firm that was coincidentally researching ways to get around the Article 2 requirements of the U.S. Constitution for service as president," he said.

"This appears to be an ongoing attempt by Mr. Obama to obtain the presidency while avoiding and evading all questions on his eligibility," he said.

Kreep said the judge’s ruling leaves open the option for any candidate, resident or not, alive or not, to run for the office of president.

"California has a history of removing people from the ballot who are not qualified to run for president," Kreep said. "The most famous case being Eldridge Cleaver."

"It is incumbent upon us here at the USJF to continue this fight to learn the truth," he said.

In the court’s decision to dismiss the case, the judge rejected concerns over the problems that could result if a president was found to be ineligible.

"If Mr. Obama is not constitutionally eligible to serve as president of the United States, then no act that he takes is, arguably, valid, the laws that he signs would not be valid, the protective orders that he signs would be null and void, and every act that he takes would be subject to legal challenge, both in courts of the United States of America, and in international courts, and that, therefore, it is important for the voters to know whether he, or any candidate for president in the future, is eligible to serve in that office," the case explained.

The case documents previously explained that in 1968 the Peace and Freedom Party submitted the name of Eldridge Cleaver as a qualified candidate for president. But then-Secretary of State Frank Jordan "found that, according to Mr. Cleaver’s birth certificate, he was only 34 years old, one year shy of the 35 years of age needed to be on the ballot as a candidate for president."

USJF explained that "using his administrative powers, Mr. Jordan removed Mr. Cleaver from the ballot. Mr. Cleaver unsuccessfully challenged this decision to the Supreme Court of the State of California, and, later, to the Supreme Court of the United States."

The USJF said similarly, in 1984, Peace and Freedom Party candidate Larry Holmes was removed from the ballot.

Keyes has been critical of judges’ refusal to listen to evidence in the disputes and suggestions that those who bring such allegations for review should be penalized..

"In the final analysis if the courts refuse to respect the Constitution, they are not the judges of their own action. The people must ultimately decide. Which is why I and others will use every outlet to inform them of the injustice being done not just to individuals but to the sovereign people as a whole," Keyes said.

In a commentary on the dispute, Keyes wrote that the suggestion of sanctions against those who bring up the questions, already raised as an issue by Obama’s lawyers in his case, "confirms Obama’s ruthless determination to destroy anyone who continues to seek the information the Constitution requires.

"Why should they demand penalties against citizens who are simply seeking the enforcement of the Supreme Law of the Land? It is simply because their persistence runs contrary to the will of a supposedly popular demagogue? This smacks of tyrannical arrogance. That Obama thus signals his intent to bring financial ruin on those who won’t accept his cover-up of the circumstances of his birth is a tactical escalation," Keyes said.

"As one of the targets of this escalation, I need no more convincing proof of the ruthless disposition so far successfully masked by his empty rhetoric of hope and change. Obviously he means to offer hope only to those willing to surrender their most basic rights. To any who insist on questioning his actions, he offers the drastic change of ruin and destruction. So be it. We shall be among those who learn firsthand the meaning of the sacrifices made by the Founders of our free republic, as they pledged and gave up their lives, their fortunes and the world’s esteem," Keyes said.

President Obama has been named in dozens of civil lawsuits alleging he is not eligible to be president, with one man even filing a criminal complaint alleging the commander-in-chief is a fraud, and now a citizen grand jury in Georgia has indicted the sitting president.

The indictment delivered to state and federal prosecutors yesterday is one of the developments in the dispute over Obama’s eligibility to be president under the U.S. Constitution’s requirement that presidents be "natural born" citizens.

Orly Taitz , a California attorney working on several of the civil actions, also announced she has filed another Quo Warranto case in the District of Columbia, where, she told WND, the statutes acknowledge that procedure.

The Quo Warranto claim essentially calls on Obama to explain by what authority he has assumed the power of the presidency.

Georgia resident Carl Swensson, whose work is detailed on his Rise up for America website, told WND he got tired of the issues over Obama’s eligibility, as well as his performance in office.

"I took it upon myself to find as many patriots as I could across the state, for the purpose of seating 25 for a grand jury," he said.

Over the weekend the jurors took sworn testimony from several sources, including Taitz, and then generated an indictment that later was forwarded to the U.S. attorney, the state attorney general and others in law enforcement across the state.

Swensson cites on his website as authority for the grand jury the Magna Carta, the bill of rights that formed the foundation of British common law on which U.S. law is based.

He said the members were chosen, sworn in and observed all of the rules of procedure. Swensson declined to elaborate on the specific allegations about Obama, telling WND that remains confidential at this point because of the possibility of a prosecution.

However, the website explanation of the procedure includes some intimidating language.

"If the government does not amend the error within 40 days after being shown the error, then the four members shall refer the matter to the remainder of the grand jury," it says. "The grand jury may distrain and oppress the government in every way in their power, namely, by taking the homes, lands, possessions, and any way else they can until amends shall have been made according to the sole judgment of the grand jury."

Swensson said the indictments were delivered to the U.S. attorney for the Northern District of Georgia, state officials and leaders of the Georgia Senate and House.

He told WND that since the action in Georgia, he’s been contacted by groups in at least 20 other states who want to pursue a similar action.

Meanwhile, Taitz told WND she has forwarded to U.S. Attorney Jeffrey Taylor in Washington, D.C., a request for the U.S. to relate Quo Warranto "on Barack Hussein Obama, II to test his title to president."

Named as plaintiffs in the action are nine military or legislative leaders, including Allen C. James, currently on active duty in the U.S. Army in Iraq. Others include several retired military leaders as well as elected state representatives.

"Relators request that as U.S. Attorney, you institute a Quo Warranto proceeding against Obama under DC Code § 16-3502, and demand that Obama show clear title, proving, with clear and convincing evidence, that he had qualified as president elect," Taitz told Taylor.

"By each relator’s constitutional oath of office, and interest above other citizens and taxpayers, relators submit that they have standing," Taitz wrote.

"In arguendo of Respondent Obama’s burden of proof, motions are submitted requesting mandamus on Hawaii Gov. Linda Lingle for evidence, and on Sec. State Hillary Rodham Clinton for evidence and to request evidence from Britain and the Republics of Kenya, Indonesia and Pakistan," Taitz said.

She told WND the case was filed in the District of Columbia because the district recognizes the procedure. Taitz, who is working on her cases through the Defend Our Freedoms Foundation , cites a legal right established in British common law nearly 800 years ago and recognized by the U.S. Founding Fathers to demand documentation that may prove – or disprove – Obama’s eligibility to be president.

She previously submitted a similar case to U.S. Attorney General Eric Holder.

The legal phrase essentially means an explanation is being demanded for what authority Obama is using to act as president. An online constitutional resource says Quo Warranto "affords the only judicial remedy for violations of the Constitution by public officials and agents."

John Eidsmoe, an expert on the U.S. Constitution now working with the Foundation on Moral Law, said the demand is a legitimate course of action.

"She basically is asking, ‘By what authority’ is Obama president," he told WND. "In other words, ‘I want you to tell me by what authority. I don’t really think you should hold the office.’

"She probably has some very good arguments to make," Eidsmoe said.

WND has reported on dozens of legal challenges to Obama’s status as a "natural born citizen." The Constitution, Article 2, Section 1, states, "No Person except a natural born Citizen, or a Citizen of the United States, at the time of the Adoption of this Constitution, shall be eligible to the Office of President."

Some of the lawsuits question whether he was actually born in Hawaii, as he insists. If he was born out of the country, Obama’s American mother, the suits contend, was too young at the time of his birth to confer American citizenship to her son under the law at the time.

Other challenges have focused on Obama’s citizenship through his father, a Kenyan subject to the jurisdiction of the United Kingdom at the time of his birth, thus making him a dual citizen. The cases contend the framers of the Constitution excluded dual citizens from qualifying as natural born.

Several of the civil cases already have involved emergency appeals to the U.S. Supreme Court in which justices have declined even to hear arguments.

Eidsmoe said it’s clear that Obama has something in the documentation of his history, including his birth certificate, college records and other documents, "he does not want the public to know."

What else could be the reason for his hiring law firms across the nation to fight any request for information as basic as his Occidental College
records from the early 1980s, he asked.

According to the online Constitution.org resource: "The common law writ of quo warranto has been suppressed at the federal level in the United States, and deprecated at the state level, but remains a right under the Ninth Amendment which was understood and presumed by the Founders, and which affords the only judicial remedy for violations of the Constitution by public officials and agents."

According to author Chester Antieau in his "The Practice of Extraordinary Remedies," Quo Warranto is one of the oldest rights in common law.

"The earliest case on record appears in the 9th year of Richard I, 1198," he wrote. "The statute of 9 Anne c. 20 in 1710 authorized a proper officer of a court, with leave of the court, to exhibit an information in the nature of quo warranto, at the ‘relation’ of any person desiring to prosecute the same – to be called the relator. Early American statutes were modeled after the Statute of Anne and, indeed, the statute has often been ruled to be part of the common law we inherited from England."

Antieau noted the Pennsylvania Supreme Court has ruled, "Quo warranto is addressed to preventing a continued exercise of authority unlawfully asserted, rather than to correct what has already been done. …"

Its first recognized purpose, he said, is "to determine the title of persons claiming possession of public offices and to oust them if they are found to be usurpers."

Among those who are subject to its demands, under court precedent, are chief executives in other U.S. governmental positions, including governors and sheriffs.

As WND has reported on several occasions, none of the so-called "evidence" of Obama’s constitutional eligibility produced thus far is beyond reasonable doubt nor as iron-clad as simply producing an authentic birth certificate, something Americans are required to do regularly but the president still refuses to do.

Adding fuel to the fire is Obama’s persistent refusal to release documents that could provide answers. While his supporters cite an online version of a "Certification of Live Birth" from Hawaii, critics point out such documents actually were issued for children not born in the state.

As Jerome Corsi, WND senior staff writer, explained, "The main reason doubts persist regarding Obama’s birth certificate is this question: If an original Hawaii-doctor-generated and Hawaii-hospital-released Obama birth certificate exists, why wouldn’t the senator and his campaign simply order the document released and end the controversy?

"That Obama has not ordered Hawaii officials to release the document," Corsi writes, "leaves doubts as to whether an authentic Hawaii birth certificate exists for Obama."

Obama officials repeatedly have declined comment, relenting only one time to call such allegations "garbage."

WND also has reported that Taitz’ appeals have been submitted to the U.S. Supreme Court and the U.S. Justice Department, where officials confirmed they received the paperwork.

WND reported earlier on a proposal by U.S. Rep. Bill Posey, R-Fla., and the criticism he’s taking for suggesting that the issue be avoided in the future by having presidential candidates supply their birth certificate.

Gary Kreep of the United States Justice Foundation also has confirmed to WND a civil case brought on behalf of Ambassador Alan Keyes, a candidate for president on California’s general election ballot last year, challenging Obama’s eligibility will be appealed.

WND reported earlier on the case being filed and then again when a judge dismissed it after concluding anyone can run for president on the California ballot – whether or not they are eligible under the Constitution of the United States.

Judge Michael P. Kenny said the secretary of state, who is responsible for election laws in the state, has no "duty" to demand proof of eligibility from candidates.

"The judge’s ruling in the case that only Congress and only on Jan. 6 of each year following a presidential election can object as to whether the nominee is eligible to serve as president of the United States is, in our opinion, completely wrong and eviscerates the [Constitutional] requirements for serving as president in the United States Constitution," Kreep said.

"If Mr. Obama is not constitutionally eligible to serve as president of the United States, then no act that he takes is, arguably, valid, the laws that he signs would not be valid, the protective orders that he signs would be null and void, and every act that he takes would be subject to legal challenge, both in courts of the United States of America, and in international courts, and that, therefore, it is important for the voters to know whether he, or any candidate for president in the future, is eligible to serve in that office," the case explained.

A California attorney battling on a number of fronts to obtain documentation of Barack Obama’s eligibility to be president is asking the FBI and U.S. Secret Service to investigate suspected "tampering" at the U.S. Supreme Court.

Orly Taitz, who is pursuing nearly half a dozen causes through her Defend Our Freedoms Foundation, says the issue of Obama’s eligibility to meet the Constitution’s demand for a "natural born" president has been before the Supreme Court at least four times.

But she wonders whether the justices actually were given the pleadings to review.

"I believe … that there was tampering with documents and records by employees of the Supreme Court and the justices never saw those briefs," she alleges in a letter to the FBI’s Robert Mueller, the Secret Service’s Mark Sullivan and Attorney General Eric Holder.

"Three hundred five million American citizens … need to know whether a foreign national is usurping the position of the president and the commander in chief," she wrote.

Taitz raises questions about "forgery of court records, tampering with court records, cyber crime, erasing of court records from the docket, fraud, mail fraud, wire fraud and other related crimes."

Specifically, she points to the handling of her own case, Lightfoot v. Bowen, which was submitted to the Supreme Court on an emergency basis. Although it was scheduled for a conference, no hearing ever was held.

Taitz notes that references to the case were erased from the docket of the Supreme Court on Jan. 21, shortly after Obama, the defendant, met with eight of the nine justices behind closed doors.

Secondly, Taitz notes that in her conversation with Justice Antonin Scalia at a book-signing in Los Angeles several weeks ago, he appeared to have no knowledge of the cases that had been submitted.

She said she mentioned her case and those brought by Cort Wrotnowski, Philip Berg and Leo Donofrio.

"In the presence of several attorneys, law students and Secret Service agents Justice Scalia kept saying that he didn’t know anything … even though all of the plaintiffs have received notification that all of those cases were reviewed by all nine justices," she said.

Taitz said she’s also concerned that the Supreme Court docket was somehow modified.

"Did somebody from outside break and enter into the computer system of the Supreme Court or was it done by one of the overzealous employees who wanted to keep Obama in the White House?" she asked.

"I demand to see the printout of entries of both internal docket seen by justices and the external docket seen by the public to verify if those were identical at all times, particularly between January 20th and January 23rd," she said.

She also raised the possibility that justices’ signatures may have been "stamped" on documentation.

Her allegations, she said, were part of what she submitted to Chief Justice John Roberts when she met him at the University of Idaho a week ago.

"Due to the … great urgency of the matter in relation to the national security of the United States … I demand immediate investigation of this matter," Taitz wrote.

A California attorney lobbying the U.S. Supreme Court for a review of Barack Obama’s qualifications to be president confronted the chief justice yesterday with legal briefs and a WND petition bearing names of over 325,000 people asking the court to rule on whether or not the sitting president fulfills the Constitution’s "natural-born citizen" clause.

According to Orly Taitz, the attorney who confronted Chief Justice John Roberts at a lecture at the University of Idaho, the judge promised before the gathered crowd that he would, indeed, read and review the briefs and petition.

"I addressed him in front of 800 people in the audience," Taitz told WND, "including university officials, the president of the Idaho State Bar and the chief justice of the Supreme Court of Idaho, and in front of all them, [Roberts] promised to read my papers."

Roberts was lecturing on Abraham Lincoln to approximately 1,200 attendees of the annual Bellwood Memorial Lecture Series at the Moscow, Idaho, university. Roberts has been chief justice of the Supreme Court since his nomination by President George W. Bush and subsequent confirmation in 2005.

Earlier in the week, Taitz confronted Supreme Court Justice Antonin Scalia, who told her the issue of Obama’s eligibility, which has been raised before the Supreme Court at least four times but has yet to be given a single hearing, still lacked the votes of the required four justices in conference before it would be officially heard.

Taitz said, "I told Scalia that I was an attorney that filed Lightfoot v. Bowen that Chief Justice Roberts distributed for conference on Jan. 23 and now I represent nine state reps and 120 military officers, many of them high ranked, and I want to know if they will hear Quo Warranto and if they would hear it on original jurisdiction, if I bring Hawaii as an additional defendant to unseal the records and ascertain Obama’s legitimacy for presidency."

The legal phrase Quo Warranto essentially means an explanation is being demanded for what authority Obama is using to act as president. An online constitutional resource says Quo Warranto "affords the only judicial remedy for violations of the Constitution by public officials and agents."

"Tell me what to do, what can I do?" Taitz reports asking Scalia. "Those soldiers [her plaintiffs] can be court-martialed for asking a legitimate question, who is the president, is he legitimate?"

She says Scalia responded, "Bring the case, I’ll hear it, I don’t know about others."

In Idaho, Taitz obtained the promise of one of the others, the chief justice, that he would read through the eligibility challenge, including the petition brought by WND readers.

As WND reported, Taitz is submitting a motion to the Supreme Court for re-hearing of Lightfoot v. Bowen, a case she is working on through her foundation Defend Our Freedoms, alleging some of her documentation may have been withheld from the justices by a court clerk.

She asserts docketing information about her case "was erased from the docket of the Supreme Court on January 21st, one day after the inauguration and two days before [the case was to be heard]."

At the lecture in Idaho, Taitz grabbed the attention of Justice Roberts by boldly addressing her allegation that a clerk had buried the case.

Taitz told WND that the forum rules required that those questioning Roberts announce their relationship to the University of Idaho and refrain from talking about cases currently before or likely to appear before the court.

"I said, ‘Justice Roberts, my name is Orly Taitz. I’m an attorney from California, and I got up at 3 o’clock in the middle of the night, flew and drove thousands of miles just to ask you a question. So please give me some leeway,’" Taitz told WND. "My question is, do you know there is illegal activity going on in the Supreme Court of the United States?"

According to Taitz, the room was stunned silent as she continued, "I have presented my case to you, and you personally agreed to hear this case in conference. But your clerk refused to forward a supplemental brief to you. He has hidden this brief from you. He refused to put it on the docket. Additionally, my case was erased from the docket one day after the Inauguration, two days before my case was to be heard.

"Outraged citizens and members of the media and state representatives are calling the Supreme Court, demanding to have the case reentered on the docket," Taitz told Roberts.

Then she held up the WND petition and continued, "Moreover, here are the names of U.S. citizens who signed this petition and who sent individual letters to individual justices, including you, Justice Roberts, all of them demanding the same thing – that you hear my case in regards to Barack Hussein Obama’s eligibility for presidency."

According to Taitz, Roberts approached the microphone and said, "I see you have papers. I promise you I will read all your papers, I will review them. Please give them to my Secret Service and I will review all of them."

Shortly thereafter, Taitz told WND, a Secret Service agent identified by his badge as Gilbert Shaw accepted two suitcases of documents and pledged to deliver them to Roberts.

Taitz reports the documents included four major sections:

* A motion for reconsideration of Lightfoot v. Bowen with all its supplemental briefs.

* The Quo Warranto Easterling et al v. Obama et al case.

* The WND petition, consisting of 3,300 pages of names – over 325,000 in all – of people demanding the Supreme Court hear the Obama eligibility case.

* A copy of a 164-page dossier sent to Attorney General Eric Holder detailing suspected criminal activity surrounding Obama and his supporters, also available on the Defend Our Freedoms website.

WND has reported on dozens of legal challenges to Obama’s status as a "natural born citizen." The Constitution, Article 2, Section 1, states, "No Person except a natural born Citizen, or a Citizen of the United States, at the time of the Adoption of this Constitution, shall be eligible to the Office of President."

Some of the lawsuits question whether he was actually born in Hawaii, as he insists. If he was born out of the country, Obama’s American mother, some suits contend, was too young at the time of his birth to confer American citizenship to her son under the law at the time.

Other challenges have focused on Obama’s citizenship through his father, a Kenyan subject to the jurisdiction of the United Kingdom at the time of his birth, thus making him a dual citizen. The cases contend the framers of the Constitution excluded dual citizens from qualifying as natural born.

* Leo Donofrio of New Jersey filed a lawsuit claiming Obama’s dual citizenship disqualified him from serving as president. His case was considered in conference by the U.S. Supreme Court but denied a full hearing.

* Cort Wrotnowski filed suit against Connecticut’s secretary of state, making a similar argument to Donofrio. His case was considered in conference by the U.S. Supreme Court, but was denied a full hearing.

* Former presidential candidate Alan Keyes headlines a list of people filing a suit in California, in a case handled by the United States Justice Foundation, that asks the secretary of state to refuse to allow the state’s 55 Electoral College votes to be cast in the 2008 presidential election until Obama verifies his eligibility to hold the office. The case was dismissed by Judge Michael P. Kenny.

* Chicago attorney Andy Martin sought legal action requiring Hawaii Gov. Linda Lingle to release Obama’s vital statistics record. The case was dismissed by Hawaii Circuit Court Judge Bert Ayabe.

* Lt. Col. Donald Sullivan sought a temporary restraining order to stop the Electoral College vote in North Carolina until Barack Obama’s eligibility could be confirmed, alleging doubt about Obama’s citizenship. His case was denied.

* In Ohio, David M. Neal sued to force the secretary of state to request documents from the Federal Elections Commission, the Democratic National Committee, the Ohio Democratic Party and Obama to show the presidential candidate was born in Hawaii. The case was denied.

* Also in Ohio, there was the Greenberg v. Brunner case which ended when the judge threatened to assess all case costs against the plaintiff.

* In Washington state, Steven Marquis sued the secretary of state seeking a determination on Obama’s citizenship. The case was denied.

* In Georgia, Rev. Tom Terry asked the state Supreme Court to authenticate Obama’s birth certificate. His request for an injunction against Georgia’s secretary of state was denied by Georgia Superior Court Judge Jerry W. Baxter.

On the heels of two active duty members of the U.S. military serving in Iraq calling for President Obama to prove his eligibility to be president, a retired major general has agreed to join the case, saying he just wants "the truth."

WND reported earlier when 1st Lt. Scott Easterling confirmed to California attorney Orly Taitz that he wanted to be a plaintiff in the legal action she is preparing on behalf of members of the U.S. military, both active and retired. A second soldier who asked that his name be withheld for now became part of the action just a day later.

Now retired Maj. Gen. Carroll D. Childers has submitted a statement to Taitz and her DefendOurFreedoms.us website, agreeing to be a plaintiff in her pending action.

"I agree to be a plaintiff in the legal action to be filed by Orly Taitz, Esq. in a petition for a declaratory judgement (sic) that Barack Hussein Obama is not qualified to be president of the U.S., nor to be commander in chief of the U.S. armed forces, in that I am or was a sworn member of the U.S. military (subject to recall)," he wrote.

If recalled, he would be "unable to follow any orders given by a constitutionally unqualified commander in chief, since by doing so I would be subject to charges of aiding and abetting fraud and committing acts of treason," he wrote.

In an accompanying letter, Childers said, "What I really want is the truth; is Obama a natural born citizen of the United States. If not a natural born citizen, America has been defrauded and then we would be stuck with Joe Biden whose only redeeming attribute is that he is probably not a communist."

He said he is an engineer after serving for 38 years in Vietnam, the Persian Gulf, Operation Desert Storm and other locations.

Childers said there were a long list of reasons he didn’t support Obama for president, including "his crime associates in the USA … his promise to make coal power industry bankrupt … his spread the wealth admission … his associations with foreign leaders unfriendly to the USA … (and his lack of) integrity."

But he said he believes Obama is not eligible to be president, a claim Obama spokesmen have described to WND as "garbage."

The Constitution, Article 2, Section 1, states, "No Person except a natural born Citizen, or a Citizen of the United States, at the time of the Adoption of this Constitution, shall be eligible to the Office of President."

Several of the cases have involved emergency appeals to the U.S. Supreme Court in which justices have declined to hear arguments. Among the cases turned down without a hearing at the high court have been petitions by Philip Berg, Cort Wrotnowski, Leo Donofrio and Taitz.

Military.com reported Easterling’s concerns following WND’s report and confirmed that Army officials said they were aware of the lieutenant’s letter. The officials, Military.com said, are trying to balance the "military requirements under the Uniform Code of Military Justice versus critical freedoms that all Americans enjoy."

Commenters on the website called the soldier "a delusional racist," "moronic and irrelevent (sic)," and undeserving of his uniform.

However, some defended him.

"The questions about the POTUS and his birth were questions raised during the campaign – quite often in this website. This question was not always answered in a fashion which was clear cut yea or nay," said one forum contributor. "There are lawsuits ongoing – therefore there are other doubters."

Said another, "If anybody does their research they find out that a full investigation was conducted regarding McCain’s eligibility (born on a military base on foreign soil), but no such investigation was done for BO. BO admits to traveling to Pakistan in 1981, when it was illegal to do so for US citizens at the time, how did he pull that off?

"Open your eyes, lemmmings (sic)," the participant wrote.

Another pointed out that the lieutenant certainly has a right to his opinion, but most importantly, he is staying true to his duty.

"All of your rhetoric truly makes me question your morality. Some of you say that this LT needs to be reprimanded in this way or that, but what you people forget to see through your blinders is that this LT is still fighting the fight, no matter what. He still is part of the reason you have the right to say the things you do. He still believes the American way of life is still precious and should stay that way no matter what. And whether he chooses his God given freedom to voice that God given right is up to him."

Another had a pointed comment about the entire issue.

"Why doesn’t the president just put his credentials out there and stop all the speculation?"

Another member of the military who contacted WND, who identified himself only by his initials, explained: "I am in the United States Air Force and I had to produce my birth certificate to enter the service. What documents did Mr. Obama use to enter in the race for president? I had to produce my birth certificate to have a passport issued. Does Mr. Obama have a passport? What documents did he use to get it? My children have to produce their birth certificate to get a driver’s license. Does Mr. Obama have a driver’s license? What documents did he use to get it? I had to produce a birth certificate to get a Social Security number issued for me and my children. Does Mr. Obama have a Social Security number issued? What documents did he use to get it? "

Taitz explained the issue isn’t resolved as many Obama supporters claim.

The "Certification of Live Birth" posted on the Internet actually doesn’t confirm a birth location.

"[Hawaii] statute 138 allows foreign born children of HI residents to get HI [Certificates of Live Birth] and get them based on a statement of one relative only," she said.

She also said Hawaiian officials, while they confirmed a birth certificate exists, did not exclude the possibility it was "one obtained for a foreign born child."

She also cited Obama’s immigration to Indonesia at age 5, when he was considered an Indonesian citizen.

Also, in a case being handled largely by Gary Kreep of the United States Justice Foundation in California, lawyers hired to represent Obama have admitted that such disputes should have been resolved in Congress.

That case is seeking documentation of Obama’s attendance at Occidental College, and in an effort to keep all of those records secret, a law firm has argued that state and federal courts have no authority over the case.

"Federal law establishes the procedure for election of the President and Vice President and provides the exclusive means for challenges to their qualifications," the court filing said. In the absence of objections filed by members of the Senate and House of Representatives, "which would have been resolved by those bodies," Obama was declared the president.

Soldier Scott Easterling. A U.S. soldier on active duty in Iraq has called President Obama an "impostor" in a statement in which he affirmed plans to join as plaintiff in a challenge to Obama’s eligibility to be commander in chief.

The statement was publicized by California
attorney Orly Taitz who, along with her Defend Our Freedom Foundation, is working on a series of legal cases seeking to uncover Obama’s birth records and other documents that would reveal whether he meets the requirements of the U.S. Constitution.

"As an active-duty officer in the United States Army, I have grave concerns about the constitutional eligibility of Barack Hussein Obama to hold the office of president of the United States," wrote Scott Easterling in a "to-whom-it-may-concern" letter.

Obama "has absolutely refused to provide to the American public his original birth certificate, as well as other documents which may prove or disprove his eligibility," Easterling wrote. "In fact, he has fought every attempt made by concerned citizens in their effort to force him to do so."

Taitz told WND she had advised Easterling to obtain legal counsel before making any statements regarding the commander-in-chief, but he insisted on moving forward. His contention is that as an active member of the U.S. military, he is required to follow orders from a sitting president, and he needs – on pain of court-martial – to know that Obama is eligible.

Taitz said other legal cases questioning Obama’s eligibility filed by members of the military mostly have included retired officers, and courts several times have ruled they don’t have standing to issue their challenge.

Easterling, however, is subject to enemy fire and certainly would have a reason to need to know the legitimacy of his orders, she argued.

"Until Mr. Obama releases a ‘vault copy’ of his original birth certificate for public review, I will consider him neither my Commander in Chief nor my President, but rather, a usurper to the Office – an impostor," his statement said.

Easterling said he joined the Army at age 40 after working in Iraq as a contractor.

"I chose to work … to support my troops and then left that lucrative position when the Army raised its maximum enlistment age to 40. Upon completion of basic training, I entered Officer Candidate School and commissioned as a 2LT in August 2007. After completing the subsequent basic officer leadership courses, I was assigned to Ft. Knox and shortly thereafter deployed to Balad, Iraq," he wrote.

"I implore all service-members and citizens to contact their senators and representatives and demand that they require Mr. Obama prove his eligibility. Our Constitution and our great nation must not be allowed to be disgraced," he wrote.

Taitz said Easterling is among the plaintiffs she is assembling for a new legal action over Obama’s eligibility. Others include a list of state lawmakers who also would be required in their official position to follow orders of the president.

"My conviction is such that I am compelled to join Dr. Orly Taitz’s lawsuit, as a plaintiff, against Mr. Obama. As a citizen, it pains me to do this, but as an officer, my sworn oath to support and defend our Constitution requires this action," he said.

Easterling was "saluted" in a forum on Taitz’ website.

"Lt. Easterling, As a retired US Army SFC, I salute you sir as a true American patriot and hero! Thank you for your unselfish service to our country. It is rare to find someone today with such moral courage to do the right thing regardless of repercussions," said one contributor.

Said another, "For your voluntary service to our country, we owe you a debt we can never pay."

As WND reported yesterday, U.S. Sen. Richard Shelby, R-Ala., said during a meeting with constituents in Cullman County he has never seen proof the new president was born in Hawaii.

"Well, his father was Kenyan and they said he was born in Hawaii, but I haven’t seen any birth certificate," Shelby said. "You have to be born in America to be president."

Shelby’s office later stated  the senator is confident of Obama’s vetting process, although it did not elaborate.

A new lawsuit is challenging Barack Obama’s eligibility to be president, and this one targets Congress as a defendant for its "failure" to uphold the constitutional demand to make sure Obama qualified before approving the Electoral College vote that actually designated him as the occupant of the Oval Office.

The new case raises many of the same arguments as dozens of other cases that have flooded into courtrooms around the nation since the November election.

It is being brought on behalf of Charles F. Kerchner Jr., Lowell T. Patterson, Darrell James Lenormand and Donald H. Nelson Jr. and names as defendants Barack Hussein Obama II, the U.S., Congress, the Senate, House of Representatives and former Vice President Dick Cheney along with House Speaker Nancy Pelosi.

As WND has reported, dozens of lawsuits have been filed over Obama’s eligibility to assume the office of the president. Many have been dismissed while others remain pending.

The cases, in various ways, have alleged Obama does not meet the "natural born citizen" clause of the U.S. Constitution, Article 2, Section 1, which reads, "No Person except a natural born Citizen, or a Citizen of the United States, at the time of the Adoption of this Constitution, shall be eligible to the Office of President."

Some of the legal challenges have alleged Obama was not born in Hawaii, as he insists, but in Kenya. Obama’s American mother, the suits contend, was too young at the time of his birth to confer American citizenship to her son under the law at the time.

Other challenges have focused on Obama’s citizenship through his father, a Kenyan subject to the jurisdiction of the United Kingdom at the time of his birth, thus making him a dual citizen. The cases contend the framers of the Constitution excluded dual citizens from qualifying as natural born.

Several details of Obama’s past have added twists to the question of his eligibility and citizenship, including his family’s move to Indonesia when he was a child, his travel to Pakistan in the ’80s when such travel was forbidden to American citizens and conflicting reports from Obama’s family about his place of birth.

Perhaps the most perplexing detail, however, has been Obama’s refusal to allow the public release of a signed "vault" copy of his original birth certificate.

The new case was launched in New Jersey, and focuses on the alleged failure in Congress to follow the Constitution.

That document, the lawsuit states, "provides that Congress must fully qualify the candidate ‘elected’ by the Electoral College Electors."

In provides, the lawsuit said, "If the president-elect shall have failed to qualify, then the vice president elect shall act as president until a president shall have qualified."

"There existed significant public doubt and grievances from plaintiffs and other concerned Americans regarding Obama’s eligibility to be president and defendants had the sworn duty to protect and preserve the Constitution and specifically under the 20th Amendment, Section 3, a Constitutional obligation to confirm whether Obama, once the electors elected him, was qualified."

"Congress is the elected representative of the American people and the people speak and act through them," the lawsuit said.

The defendants "violated" the 20th Amendment by failing to assure that Obama meets the eligibility requirements," the lawsuit said.

In the Russian publication Pravda, commentator Mark S. McGrew addressed the subject:

"The United States Congress is required, under the U.S. Code of Federal Regulations, to count the Electoral College votes for president and vice president, ask if any member of Congress objects to the count and hear that Congressman’s objection. This is under Title 3, Chapter 1, Section 15, ‘Upon such reading of any such certificate of paper, the president of the Senate shall call for objections, if any,’" he wrote.

Several of the cases – including those brought by Orly Taitz, Cort Wrotnowski, Leo Donofrio and Philip Berg, already have been discussed in conference at the U.S. Supreme Court, which has failed to have a hearing on any of the merits involved.

Taitz, in fact, is requesting information from the Supreme Court about a meeting eight of its justices held with Obama, a defendant in her case, before the justices reviewed the issues of the case in a private conference.

Several of the cases not scheduled for hearings at the Supreme Court still remain active at lower court levels, from which emergency requests to the high court were launched.

"I know that Mr. Obama is not a constitutionally qualified natural born citizen and is ineligible to assume the office of president of the United States," Berg said in a statement on his ObamaCrimes.com website.

"Obama knows he is not ‘natural born’ as he knows where he was born and he knows he was adopted in Indonesia; Obama is an attorney, Harvard Law grad who taught Constitutional law; Obama knows his candidacy is the largest ‘hoax’ attempted on the citizens of the United States in over 200 years; Obama places our Constitution in a ‘crisis’ situation; and Obama is in a situation where he can be blackmailed by leaders around the world who know Obama is not qualified," Berg’s statement continued.

A partial listing and status update for several of the cases surrounding Obama’s eligibility to serve as president is below:

* Philip J. Berg, a Pennsylvania Democrat, demanded that the courts verify Obama’s original birth certificate and other documents proving his American citizenship. Berg’s latest appeal, requesting an injunction to stop the Electoral College from selecting the 44th president, was denied.

* Leo Donofrio of New Jersey filed a lawsuit claiming Obama’s dual citizenship disqualified him from serving as president. His case was considered in conference by the U.S. Supreme Court but denied a full hearing.

* Cort Wrotnowski filed suit against Connecticut’s secretary of state, making a similar argument to Donofrio. His case was considered in conference by the U.S. Supreme Court, but was denied a full hearing.

* Former presidential candidate Alan Keyes headlines a list of people filing a suit in California, in a case handled by the United States Justice Foundation, that asks the secretary of state to refuse to allow the state’s 55 Electoral College votes to be cast in the 2008 presidential election until Obama verifies his eligibility to hold the office. The case is pending, and lawyers are seeking the public’s support.

* Chicago attorney Andy Martin sought legal action requiring Hawaii Gov. Linda Lingle to release Obama’s vital statistics record. The case was dismissed by Hawaii Circuit Court Judge Bert Ayabe.

* Lt. Col. Donald Sullivan sought a temporary restraining order to stop the Electoral College vote in North Carolina until Barack Obama’s eligibility could be confirmed, alleging doubt about Obama’s citizenship. His case was denied.

* In Ohio, David M. Neal sued to force the secretary of state to request documents from the Federal Elections Commission, the Democratic National Committee, the Ohio Democratic Party and Obama to show the presidential candidate was born in Hawaii. The case was denied.

* In Washington state, Steven Marquis sued the secretary of state seeking a determination on Obama’s citizenship. The case was denied.

* In Georgia, Rev. Tom Terry asked the state Supreme Court to authenticate Obama’s birth certificate. His request for an injunction against Georgia’s secretary of state was denied by Georgia Superior Court Judge Jerry W. Baxter.

* California attorney Orly Taitz has brought a case, Lightfoot vs. Bowen, on behalf of Gail Lightfoot, the vice presidential candidate on the ballot with Ron Paul, four electors and two registered voters.

Private investigator Douglas Hagmann of HomelandSecurityUS.com reported earlier he found 13 cases challenging Obama’s eligibility still active or semi-active.

The biggest question was why, if a Hawaii birth certificate exists as his campaign has stated, Obama hasn’t simply ordered it made available to settle the rumors.

The governor’s office in Hawaii said there is a valid certificate but rejected requests for access and left ambiguous its origin: Does the certificate on file with the Department of Health indicate a Hawaii birth or was it generated after the Obama family registered a Kenyan birth in Hawaii?

Obama’s half-sister, Maya Soetoro, has named two different Hawaii hospitals where Obama could have been born. There have been other allegations that Obama actually was born in Kenya during a time when his father was a British subject. A one point a Kenyan ambassador said Obama’s birth place in Kenya already was recognized and honored.

Officials at Occidental College in Los Angeles, Calif., have been served with a demand to produce records concerning Barack Obama’s attendance there during the 1980s because they could document whether he was attending as a foreign national – in one of three fronts now established by those contesting the president-elect’s constitutional eligibility for the Oval Office.

The Supreme Court and Congress also both are being challenged to address the worries that Obama doesn’t meet the requirements of the U.S. Constitution that the president be a "natural born" citizen.

WND has reported on a long list of legal cases raising questions over the issue, and several of those have reached the U.S. Supreme Court already. Justices have so far declined to give any of the cases full hearings on their merits, but another conference remains on the Supreme Court docket for Jan. 23 on the issue.

"If Obama is sworn in as president, we will file a Petition for Writ of ‘Quo Warranto,’ a case that will challenge Obama as being ineligible to serve as president because he is ‘not qualified,’" said Philip J. Berg, a lawyer who has brought several cases to court. Berg, whose information is on his ObamaCrimes.com website, indicated the issue isn’t going away.

Orly Taitz, a California lawyer whose dispute remains pending before the high court, agreed, noting that one of the hearings already is scheduled for the days following Obama’s inaugural on Tuesday.

Taitz said her arguments rest on precedents from both the California Supreme Court, which years ago removed a candidate for president from the ballot because he was only 34, and the U.S. Supreme Court’s affirmation of that ruling. The Constitution requires a president to be 35.

In one of the latest developments, Gary Kreep of the United States Justice Foundation petitioned Occidental College with a demand for its records concerning Obama.

"The gravamen of the petition is the question as to whether United States Senator Barack Hussein Obama, of Illinois, is eligible to serve as president of the United States pursuant to the requirements for that office in the Untied States Constitution," he wrote. "The records sought may provide documentary evidence, and/or admissions by said defendant, as to said eligibility or lack thereof."

College officials confirmed they had gotten the notice, but had not decided how to respond, a decision that may be removed from their hands because of the team of lawyers Obama has engaged to prevent such inquiries into his past.

"Senator Obama has filed responsive pleadings in this matter and is represented by counsel, and has the opportunity to object to this production, should he so desire," the affidavit from Kreep said.

"Good cause exists for this production under Subpoena Duces Tecum, in that testimony will be elicited from the original records obtained through the witness named herein, and there is no other process available to secure said testimony," he wrote.

The lawsuits allege in various ways Obama does not meet the "natural born citizen" clause of the U.S. Constitution, Article 2, Section 1, which reads, "No Person except a natural born Citizen, or a Citizen of the United States, at the time of the Adoption of this Constitution, shall be eligible to the Office of President."

Some allege his birth took place in Kenya, and his mother was a minor at the time of his birth – too young to confer American citizenship. They argue Obama’s father, Barack Obama Sr., was a Kenyan citizen subject to the jurisdiction of the United Kingdom at the time and would have handed down British citizenship.

There also are questions raised about Obama’s move to Indonesia when he was a child and his attendance at school there when only Indonesian citizens were allowed and his travel to Pakistan in the ’80s when such travel was forbidden to American citizens.

The lawsuit on which USJF is working was filed on behalf of presidential candidate Alan Keyes and others, and describes the potential damage an ineligible president could create.

"Should Senator Obama be discovered, after he takes office, to be ineligible for the Office of President of the United States of America and, thereby, his election declared void," argues a case brought on behalf of Ambassador Alan Keyes, also a presidential candidate. "Americans will suffer irreparable harm in that (a) usurper will be sitting as the President of the United States, and none of the treaties, laws, or executive orders signed by him will be valid or legal."

On his ObamaCrimes.com website, Berg sent his message directly to the U.S. Congress.

He’s asking in an open letter to members of Congress for congressional hearings "to determine the truth regarding qualifications of Barry Soetoro, otherwise known as Barack Hussein Obama…"

"As you must be aware, there are many unresolved questions concerning Soetoro/Obama’s status or lack thereof, as a ‘natural born’ American citizen, as required by ‘our’ U.S. Constitution," he wrote.

He noted the failure by Congress to challenge Obama’s eligibility during the process through which the Electoral College vote was adopted.

"Because of your failure to ‘question’ the eligibility of Soetoro/Obama, we are headed for a ‘Constitutional Crisis.’ Yes, a ‘Constitutional Crisis’ because Soetoro/Obama who appears not to be a ‘natural born’ U.S. citizen is ‘ineligible’ under ‘our’ U.S. Constitution to serve as president," he said.

He cited the document published on the Internet by Obama’s campaign, the "Certification of Live Birth," as no more than an effort to "quash" questions. Other critics have noted the state of Hawaii granted such certifications to parents of children not born in the state at the time.

"Without truthful information concerning Soetoro/Obama’s eligibility to serve as President, ‘We the People’ have been injured," he wrote.

Taitz took a different route, submitting to the U.S. Supreme Court a motion "to declare that by default, the president elect respondent Barack Obama has failed to qualify under [the] U.S. Constitution."

"Does the burden of proof lie with the petitioner to prove standing and evidence lack of qualification by a candidate/president elect, where election officers rely on a candidate’s declaration? OR does the [Constitution] place the burden of proof on the president-elect to provide objective government certified witnessed proofs, with election officers under oath to challenge, examine and declare that the president elect has or has not qualified, enforceable by petition for redress of grievances?"

Not only has the respondent, Obama, "failed to submit proofs … for any of the qualifications," she wrote. "Respondent has hindered discovery."

She argued that having Obama declared ineligible until he would provide documentation would "cause far less political trauma" than allowing his inauguration because it would uphold the constitution.

She also raised the issue of the concealment of Obama’s records.

"Obama has refused to submit certified copies of any of his original long form ‘vault’ birth certificates in Hawaii to any public officer or to any Petitioner. Relevant records in Kenya have also been officially restricted," she said. "Obama has sealed all educational records which might reveal his stated citizenship. These include Punahou High School, Occidental College, Columbia University, and Harvard Law School."

Her letter included a warning, too.

"Thirty-three democracies descended into tyranny during the 20th century by failing to uphold constitutional protections," she said. "Petitioner humbly prays this Court evaluate the Petitioner’s case in context of how best to enforce restrictive qualifications for president to preserve the Constitution and Republic from tyranny."

A second conference has been posted on the docket for the U.S. Supreme Court over the issue of Barack Obama’s eligibility to occupy the White House, this one scheduled a week after Congress is to review the Electoral College vote tabulation.

The latest issue posted is a request for an injunction on the election results pending the resolution of a petition for a writ of certiorari filed by attorney Philip J. Berg, a case that is docketed for a similar conference among the justices on Jan. 9.

Berg’s original case raises questions about Obama’s eligibility and his injunction request first was filed early in December. It was submitted to and rejected by two different justices before it came before Justice Antonin Scalia on Dec. 18. Then just before Christmas the docket was updated to reflect that the motion had been "distributed for conference of January 16, 2009."

On Berg’s Obama Crimes.org website, he said Congress is scheduled to hear the Electoral College results on Jan. 8. Then on Jan. 9 there’s the conference scheduled on Berg’s case itself, with the injunction issue to be addressed a week later.

WND has reported Berg’s case, one of the first legal challenges to Obama’s eligibility to reach the Supreme Court, alleges he cannot constitutionally be inaugurated.

Last month, WND reported the worries over a "constitutional crisis" that could be looming over the issue of Obama’s citizenship.

"Should Senator Obama be discovered, after he takes office, to be ineligible for the Office of President of the United States of America and, thereby, his election declared void," argues the Alan Keyes case pending in California, "Americans will suffer irreparable harm in that (a) usurper will be sitting as the President of the United States, and none of the treaties, laws, or executive orders signed by him will be valid or legal."

With such high stakes potentially at risk, WND earlier launched a letter campaign to contact Electoral College members and urge them to review the controversy.

That followed a campaign that sent more than 60,000 letters by overnight delivery to the U.S. Supreme Court when one case contesting Obama’s eligibility for the Oval Office was pending.

A separate petition, already signed by more than 190,000 also is ongoing asking authorities in the election to seek proof Obama was born in the U.S. or that he fulfills the "natural-born American" clause in the Constitution.

WND senior reporter Jerome Corsi had gone to both Kenya and Hawaii prior to the election to investigate issues surrounding Obama’s birth. But his research and discoveries only raised more questions.

The biggest question was why, if a Hawaii birth certificate exists as his campaign has stated, Obama hasn’t simply ordered it made available to settle the rumors. The image his campaign posted online has been rejected by critics since it is a "certification of live birth," not a birth certificate, and under Hawaii law at the time such certifications were given to parents of children born outside the state.

The governor’s office in Hawaii said there is a valid certificate but rejected requests for access and left ambiguous its origin: Does the certificate on file with the Department of Health indicate a Hawaii birth or was it generated after the Obama family registered a Kenyan birth in Hawaii?

Obama’s half-sister, Maya Soetoro, has named two different Hawaii hospitals where Obama could have been born. There have been other allegations that Obama actually was born in Kenya during a time when his father was a British subject. At one point a Kenyan ambassador said Obama’s birthplace in Kenya already was being recognized.
